Judicial Authority Mechanisms from the Perspective of Ayatollah Khamenei, with a Focus on Domestic Security and Stability

Abstract
According to Article 156 of the Constitution, the primary duties of the Judiciary include promoting justice and legitimate freedoms, supervising the proper implementation of laws, addressing grievances, restoring public rights, detecting crimes, prosecuting and punishing offenders, implementing divine laws, and taking appropriate measures for crime prevention. The overall outcome of fulfilling these responsibilities is the establishment, safeguarding, and consolidation of domestic security. Based on the statements of the Supreme Leader Ayatollah Khamenei, achieving this mission requires the Judiciary to be founded on two key pillars: authority and public trust. As one of the fundamental pillars of governance, the Judiciary must follow the Leader’s wise strategies and guidance and develop a comprehensive understanding of their essence. Failure to properly define, achieve, and exercise judicial authority and efficiency would lead to violations of people’s rights, growing dissatisfaction, and disruptions in public order and security. Therefore, the central question is: What are the components of judicial authority and efficiency from the perspective of the Leader of the Islamic Revolution, Ayatollah Khamenei? This study aims to analyze the content of Ayatollah Khamenei’s speeches, statements, and messages to identify the mechanisms of judicial authority from his perspective, with a focus on maintaining domestic security stability. This research is applied and developmental in nature and employs a qualitative methodology (using a thematic analysis approach). The study’s population consists of the collected speeches, statements, and messages of the Supreme Leader Ayatollah Khamenei from 1989 to December 2023, as published on the official website Khamenei.ir. The findings indicate that the mechanisms of judicial authority from his perspective, with a focus on domestic security stability, can be categorized into two groups: structural mechanisms and behavioral mechanisms. The structural mechanisms include principles such as “recruitment and selection,” “training and education,” “employment and appointment,” and “supervision and oversight.” The behavioral mechanisms influencing judicial authority and domestic security include “crime prevention,” “trust-building,” “security promotion,” “anti-corruption efforts,” “justice-oriented approaches,” “program-based planning and reformism,” “people-centeredness,” “judicial decisiveness,” and “adherence to the law.”
